1. Introduction and Scope
These terms and conditions (the “Terms”) govern your use of the Physique Fit Ltd (“Physique Fit”) website (www.physique-fit.co.uk), the services provided thereon, and our gym facilities. By using our site or our gym facilities, you agree to these Terms. If you do not agree with any part of these Terms, you should refrain from using our site and services.
2. Account Registration and Usage
You may be required to register an account to access certain features of our site. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Payment Terms and Billing
We offer various types of packages:
Gym only: Monthly upfront payment, membership basis unless cancelled by the client
Classes: Various monthly fees depending on the package, paid upfront each month, can be cancelled by the client
Personal Training: With any trainer at the gym, we reserve the right to vary trainers, payment is upfront in a block of pre-payment. The more sessions purchased, the lower the price.
Online coaching: 3 tier system with different price points from £50, payment is upfront, membership has to be cancelled by the client.
4. Cancellations, Refunds, and Membership Suspensions
You may cancel your membership at any time. Please note that refunds are not provided for partial membership periods or if you have not used the membership. We reserve the right to suspend or terminate your membership for any reason.
Class Cancellations and Credits:
In our commitment to fairness and to better manage class availability for all members, we have introduced a 24-hour cancellation policy for class bookings. If you need to cancel a class, please do so at least 24 hours in advance to avoid using one of your credits. Cancellations made less than 24 hours before the class start time will result in the loss of your credit, as we cannot move it to another session. To maintain fairness and accommodate unforeseen circumstances, unused class credits, for cancellations made within the policy timeframe, can be rolled over for one subsequent month, given a valid reason. Please be aware, we will not extend this grace period beyond one month.
Membership Pausing:
If you anticipate being unable to attend classes for a specific period, we encourage you to communicate this with your coach through our True Coach app. We offer the option to temporarily pause your membership until you are ready to return, ensuring you don’t lose out during your absence.
5. Intellectual Property and Content Ownership
All content on our site and within our facilities, including text, graphics, logos, images, and software, is the property of Physique Fit or its content suppliers and is protected by international copyright laws. You may not use any of our intellectual property without our prior written consent.
6. Limitation of Liability and Disclaimers
Physique Fit is not responsible for any personal injury or any other damages that may have been the result, direct or indirect, of any use or misuse of the facilities. It is your responsibility to ensure that you are medically fit to use our facilities and services.
7. User Conduct and Responsibility
You agree to comply with all rules and regulations of Physique Fit when using our facilities or services. You are responsible for any damage you cause to the facilities or equipment.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the law of England and Wales. Any dispute arising from these Terms shall be resolved in the courts of England and Wales.
9. Changes to the Terms of Service
We reserve the right to revise these Terms at any time by updating this posting. You should visit this page periodically to review the Terms because they are binding on you.
10. Website Use
All information found on this website is only to inform you about Physique Fit. Physique Fit will take reasonable care to ensure that at the time information is added to our site it is accurate. However, we cannot guarantee the accuracy of all information on our site and will not be held liable for any direct, indirect or consequential loss or damage suffered in relying on the information on our site.
You may access and download any of the contents and store it on a temporary basis for your own personal use. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

Your health and safety are of utmost importance to us. It’s vital that you consult with your doctor or a medical professional before beginning any new exercise regimen or using our facilities.
All members are expected to follow our health and safety rules and guidelines while using our facilities. Any breach of these rules may result in suspension or termination of your membership.
12. Breach of the Terms
We reserve the right to, without notice:
a) Assign the benefit of this contract to a third party. b) Terminate your access to our site at any time.
You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs, or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site.
You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
